In Greene County district court Tyler Scott Mattingly, 27, of Carroll was sentenced Feb. 14 to 10 years in prison on a charge of theft- first degree aiding and abetting. The charge is the result of his role in the Feb. 25, 2021, armed robbery of the Scranton Peoples Bank location.
Zachary Wailes, 27, was sentenced to federal prison last month for committing the robbery. Mattlngly planned the crime with Wailes. At the time of the robbery, Mattlingly was driving his car in southern Greene County when a passenger was asked to falsely report an accident, drawing law enforcement away from Scranton and increasing response time to the robbery.
Mattingly was fined $1,370 with a $205.50 surcharge; both were suspended. He and Wailes are jointly and severally liable for $32,197.07 restitution to Peoples Bank. The court ruled he is unable to pay restitution for his court appointed attorney’s fees or court costs. A charge of robbery- first degree was dismissed. (Sentencing: Honorable Christopher C. Polking)
Paul Erick Waugh, 58, of Radcliffe was sentenced to 10 years in prison after he changed his plea to guilty to a charge of theft- first degree. The prison term was suspended and he was placed on probation to the Iowa Department of Correctional Services for two years. He must pay $17,369.03 restitution to the estate of the victim of his crime. Waugh was fined $1,000 with a $150 surcharge. Court costs were $140. Jay Allen Alexander, 59, of Boone was sentenced to 180 days in jail after he pleaded guilty to a charge of fraudulent practice- third degree, amended from gambling false claim of winnings. The jail time was suspended and he was placed on probation to Boone County Probation. Alexander is jointly and severally liable with another defendant for $3,800 restitution to Wild Rose Casino. Michelle A. Christian, 36, of Grand Junction was sentenced to five years in prison after she changed her plea to guilty to a charge of possession of methamphetamine- third or subsequent offense. The prison term was suspended and she was placed on probation to the Iowa Department of Correctional Services for two years. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense, and she must also undergo a mental health evaluation and follow all recommendations at her own expense. Christian was fined $1,025 with a $153.75 surcharge. A hearing has been scheduled on her ability to pay restitution for her court appointed attorney’s fees and court costs. (Sentencing: McCarville)
Kyle Thomas Huiner, 50, of Tea, SD, was sentenced to 30 days in jail after he changed his plea to guilty to a charge of operating while intoxicated. All but two days of the jail time was suspended and he was placed on informal probation to the Greene County sheriff for one year. He has undergone a substance abuse evaluation and must complete recommended treatment. He must also complete a 12-hour impaired drivers course. Huinker was fined $1,250 with a $187.50 surcharge; one-half will be waived if he obtains a temporary restricted license. Court costs were $140. (Sentencing: McCarville)
Gerrick Smith, 24, of Jefferson was sentenced to five years in prison after he changed his plea to guilty to a charge of child endangerment causing bodily injury. The prison term was suspended and he was placed on probation to the Department of Correctional Services for 3-5 years. He was fined $1,025 with a $153.7t5 surcharge; both were suspended. Persons pleaded not guilty at arraignment as follows: Zachery Waters, 25, of Jefferson, unauthorized use of credit card more than $1,500; Kristy Jean Whisnant, 43, of Sac City, possession of methamphetamine; Richard John Sabus, 58, of Churdan, theft- second degree; Jorge Antonio Palacios, 39, of Solvag, CA, theft- first degree, criminal mischief- first degree and theft- second degree; and Richard Anthony Harris, 52, of Marshalltown, theft- first degree, criminal mischief- first degree and theft- second degree. Trial dates were set for April 5 for Waters, Whisnant, and Sabus, and for May 4 for Palacios and Harris.
A case was initiated against Brennen Meyer Weiland, 23, of Greenfield on charges of eluding causing injury while intoxicated or participating in felony, theft- second degree, and false application for license or ID card.
